Kansas City man receives over three years for possessing and transferring machinegun switches

A Kansas City, Missouri man has been sentenced in federal court for possession and transfer of machineguns, including machine gun conversion devices known as "switches."

Davorian M. Fleming, 21, received a sentence of 37 months in prison from U.S. District Judge Beth Phillips on September 9, 2025.

Fleming pleaded guilty on April 3, 2025 to charges of possession and transfer of machineguns. According to the plea agreement, Fleming admitted that the “switches” were considered machineguns under federal law and that he assisted his co-defendants in transferring these items.

One co-defendant, K’Orion A. Duff, also from Kansas City and age 23, was previously sentenced to 15 months in prison for distributing machinegun conversion devices. Two additional co-defendants are awaiting sentencing.

Federal law prohibits the possession or transfer of a machinegun as defined by Title 26, United States Code, Section 5845(b). This includes devices like “switches” that convert semi-automatic firearms into fully automatic weapons.

Assistant U.S. Attorney Ashleigh Ragner prosecuted the case following an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
